Settlement forbids marketing any product via any mechanism that a spyware program would detect or remove. Must comply with CAN-SPAM.

FTC v. Enternet Media - agreement
May not use misleading software code, nor use cookies. All affiliates must comply.

FTC v. Zuccarini - agreement
Order prevents future affiliate relationships.

Non-FTC cases

Gosbee v. Martinson as Spy Deleter
Case under RICO - computer was hijacked. Martinson claimed hijacking was done by an affiliate so he could not be held responsible. Appeals court did not agree.

L.L.Bean v. Gevalia - sealed settlement
Claria on behalf of Gevalia served ads on L.L.Bean website. Claimed trademark infringement, false advertising, unfair & deceptive trade practice, unjust enrichment, trespass to chattels, conversion.

Gator v. L.L.Bean - countersuit to Gevalia action
Gator/Claria sought declaratory judgment that pop-ups ads did not constitute unfair competition, false advertising, trademark dilution or copyright infringement. Court held that Gevalia settlement mooted the issue.
